Hearkenis provided by Qingguo Ran, an individual based in Texas, United States (“we”, “us”, or “Hearken”). These Terms of Service (the “Terms”) govern your use of the Hearkenapplication on Android, iOS, and macOS (the “app”). Please read them carefully.

1. Acceptance of terms

By downloading, installing, or using the app, you agree to be bound by these Terms. If you do not agree, do not use the app. These Terms are effective as of the “Last updated” date above.

2. License

We grant you a limited, personal, non-transferable, non-exclusive, and revocable license to install and use the app on devices you own or control, for your own personal, non-commercial use. You may not copy, modify, distribute, sell, sublicense, rent, or lease the app, and you may not reverse engineer, decompile, or disassemble any part of it except to the extent that applicable law expressly permits. All rights not expressly granted are reserved.

3. Your content & copyright

Hearkendoes not supply books or other reading material. You import your own text and documents. You retain all ownership of the content you import, and you are solely responsible for it. You represent and warrant that you own, or have the necessary rights and permissions to use, any content you import into the app, and that doing so does not infringe anyone else’s copyright or other rights.

Hearkenclaims no ownership of your content. Consistent with the app’s on-device design, your imported content stays on your device — we do not access, collect, transmit, or store it.

4. Acceptable use

You agree not to use the app for any unlawful purpose, and not to use it to reproduce, distribute, or otherwise infringe the intellectual-property or other rights of any third party. You are responsible for complying with all laws that apply to your use of the app.

5. Subscriptions & billing

Hearken offers a free, ad-supported tier and a paid subscription. The paid subscription removes ads from the app. The available billing periods and current pricing are shown in the app and on the store listing at the time of purchase. Prices may vary by region and may change over time.

Subscriptions are sold and processed by the app store you downloaded the app from — Google Play (Android) or the Apple App Store (iOS and macOS). Payment, billing, renewals, and refunds are handled by that store under its terms, not by Hearken directly.

  • Auto-renewal. Paid subscriptions renew automatically for the same period at the then-current price, and your store account is charged, until you cancel.
  • Free trial. If you start a 3-day free trial, ads are removed for the trial period. Unless you cancel before the trial ends, it automatically converts to a paid subscription and your store account is charged at the listed price. Only one trial may be available per user; availability is shown at purchase time.
  • Cancellation. You can cancel at any time through your Google Play or Apple account settings. Cancellation takes effect at the end of the current billing period; you keep paid access until then.
  • Refunds. Refunds are handled by the store under its policy — see Google Play refunds or Apple’s refund process.

6. Disclaimers

The app is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted or error-free, or that the quality or accuracy of its text-to-speech narration will meet your expectations.

7. Limitation of liability

To the maximum extent permitted by law, Hearken and its provider will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the app. To the extent liability cannot be excluded, it is limited to the amount you paid for the app, if any, in the twelve months before the claim.

8. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the app after changes take effect constitutes acceptance of the updated Terms.

9. Termination

You may stop using the app at any time and uninstall it. We may suspend or terminate your license if you breach these Terms. On termination, the license granted to you ends and you must stop using the app; the sections that by their nature should survive (including ownership, disclaimers, and limitation of liability) will continue to apply.

10. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Texas will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the app, except where applicable law gives you the right to bring proceedings elsewhere.
